TipStub Terms of Use
Version 1.0 · Effective October 3, 2026 · Tax rules as of October 3, 2026
These Terms of Use (“Terms”) are an agreement between you and Patrick Böttge, Ferdinand-Rhode-Str. 5, 04107 Leipzig, Germany (“we”, “us”), the provider of the TipStub app (“TipStub” or the “App”). They also serve as the license agreement for the App (custom EULA).
PLEASE READ SECTION 10 CAREFULLY. IT REQUIRES YOU TO RESOLVE DISPUTES WITH US THROUGH INDIVIDUAL ARBITRATION AND WAIVES CLASS ACTIONS AND JURY TRIALS, UNLESS YOU OPT OUT WITHIN 30 DAYS.
1. Acceptance and eligibility
By checking the box and tapping “Agree & Continue” in the App, you agree to these Terms. If you do not agree, do not use the App. You must be at least 18 years old and a resident of the United States to use TipStub. If Apple’s age range feature tells the App that you are under 18, the App does not let you accept these Terms.
2. What TipStub is – and what it is not
TipStub is a record-keeping and estimating tool. It helps you log your shifts, tips and overtime, prepare a monthly tip report for your employer and summarize your records for yourself or your tax professional.
TIPSTUB DOES NOT PROVIDE TAX, LEGAL, ACCOUNTING OR FINANCIAL ADVICE, AND IT DOES NOT PREPARE, REVIEW, SIGN OR FILE TAX RETURNS. It does not calculate your tax, refund or tax savings, and its estimates are not amounts to enter on a tax return.
Any estimated “qualified tips” or “qualified overtime compensation” deduction shown in the App is an automated approximation based only on the information you enter and on our understanding of federal law as of the “Tax rules as of” date shown in the App. Whether you qualify for a deduction, and in what amount, depends on facts we do not verify, including your occupation, whether your tips were voluntary, whether your overtime was required by the Fair Labor Standards Act, your filing status, your income, your Social Security number and what your employer reports on Form W-2.
WE DO NOT PROMISE OR GUARANTEE ANY DEDUCTION, REFUND OR OTHER TAX RESULT. YOUR ACTUAL DEDUCTION MAY BE LOWER THAN THE ESTIMATE OR ZERO. Estimates do not reflect Social Security, Medicare, state or local taxes. For tax year 2026 and later, the amounts your employer reports on Form W-2 control; the App’s figures only help you check them.
3. No professional relationship
Using TipStub does not create an attorney-client, accountant-client, tax-preparer, fiduciary or any other professional relationship. We are not a CPA, enrolled agent, attorney or registered tax return preparer. Replies from our support are not advice. Please confirm any estimate with a qualified tax professional or official IRS guidance before you rely on it.
4. Your responsibilities
You are responsible for:
- the accuracy and completeness of everything you enter;
- reporting your tips to your employer on time (generally by the 10th of the following month);
- keeping the records the law requires;
- reviewing every report before you sign or share it; and
- your tax returns and any taxes, interest or penalties.
Reports created with TipStub summarize your own entries. They are not official tax or payroll forms and do not replace Forms W-2, 1099 or 4137.
5. Changes in law and in the App
Tax laws and IRS guidance change. The federal tips and overtime deductions currently apply only to tax years 2025 through 2028. Estimates can become outdated. We may change, suspend or remove features, including estimates, at any time. We have no duty to update estimates or reports you created earlier.
6. License
We grant you a non-transferable, non-exclusive license to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions (including Family Sharing where enabled). You may not copy, modify, reverse engineer, resell or distribute the App except as permitted by law.
7. Subscriptions and purchases
Subscriptions and one-time purchases are processed and billed by Apple acting as our agent; your purchase contract is with us. A subscription renews automatically at the price shown in the App until you cancel it in your Apple Account settings at least 24 hours before the end of the current period. Free trials convert to paid subscriptions unless canceled before the trial ends. Refunds are handled by Apple under its policies; you can request one in the App (Settings › Request a Refund) or at reportaproblem.apple.com. The App can remind you 2 days before a free trial ends (if you turn this on), and it reminds you about 30 days before a yearly subscription renews, with the price and how to cancel (local notifications on your device, if notifications are allowed; you can turn them off in Settings). A one-time (“Lifetime”) purchase unlocks the paid features for as long as we offer the App; it does not expire, but it cannot extend the deductions beyond the tax years set by law. The monthly tip report for your employer is free and does not require a purchase. A purchase gives you access to App features; it does not buy any tax result.
8. Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, TIPSTUB AND ALL ESTIMATES, CALCULATIONS AND REPORTS ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT AND NON-INFRINGEMENT. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM US OR THROUGH THE APP CREATES ANY WARRANTY.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY TAXES, INTEREST, PENALTIES, PROFESSIONAL FEES, LOST REFUNDS OR LOST DEDUCTIONS, ARISING OUT OF OR RELATING TO YOUR USE OF, OR RELIANCE ON, TIPSTUB. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO TIPSTUB IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID FOR TIPSTUB IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US$50.
THIS SECTION DOES NOT LIMIT OUR LIABILITY FOR FRAUD, GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR ANY OTHER LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
New Jersey residents. If you live in New Jersey, the following do not apply to you to the extent New Jersey law does not permit them: (a) the disclaimer of implied warranties in Section 8, (b) the exclusion of indirect, incidental, special, consequential, exemplary and punitive damages and of taxes, interest, penalties, professional fees, lost refunds and lost deductions in Section 9, and (c) the cap on our total liability in Section 9. Nothing in these Terms limits any rights you have under the New Jersey Punitive Damages Act, the New Jersey Uniform Commercial Code or the New Jersey Consumer Fraud Act. All other parts of Sections 8 and 9 apply to you.
10. Dispute resolution: arbitration and class action waiver
10.1 Informal resolution first. Before starting any claim, you and we agree to send the other a written notice describing the individual claim and the relief requested (to us: [email protected]). We will try to resolve it within 60 days.
10.2 Binding individual arbitration. If the dispute is not resolved within 60 days, any dispute arising out of or relating to TipStub or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules and, where they apply, its Mass Arbitration Supplementary Rules. The Federal Arbitration Act governs this Section 10. The arbitration may take place by video or in the county where you live.
10.3 Small claims. Either party may instead bring an individual claim in small-claims court if it qualifies.
10.4 Fees. We will pay all AAA filing, administration and arbitrator fees, except the consumer filing fee set by the AAA rules.
10.5 WAIVER OF CLASS ACTIONS AND JURY TRIAL. YOU AND WE EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN ANY CLASS, COLLECTIVE OR REPRESENTATIVE ACTION OR ARBITRATION. A court, not an arbitrator, decides whether this waiver is enforceable and any dispute about mass-filing procedures.
10.6 Public injunctive relief. Any request for public injunctive relief will be decided by a court after the individual arbitration ends, and that court action is stayed while the arbitration is pending.
10.7 Severability. If any part of this Section 10 is found unenforceable for a claim, that claim (and only that claim) proceeds in court, and the rest of Section 10 remains in effect.
10.8 Opt-out. You may opt out of this Section 10 within 30 days after you first accept these Terms by emailing [email protected] with your name and the statement “I opt out of arbitration.” Opting out does not affect any other part of these Terms.
11. Governing law
The Federal Arbitration Act and the laws of the State of New York govern these Terms, without regard to conflict-of-law rules. This choice does not deprive you of any protection that the law of your state of residence makes mandatory.
12. Changes to these Terms
We will notify you in the App of material changes and ask you to accept them before you continue using the App. Changes do not apply to disputes you notified us of before the change.
13. Apple as third-party beneficiary and other Apple terms
- Parties. These Terms are between you and us only, not with Apple Inc. (“Apple”). We, not Apple, are solely responsible for the App and its content.
- Maintenance and support. We are solely responsible for maintenance and support. Apple has no obligation to provide any maintenance or support for the App.
- Warranty. To the extent any warranty has not been effectively disclaimed, we, not Apple, are responsible for it. If the App fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- Product claims. We, not Apple, are responsible for addressing any claims by you or a third party relating to the App or your possession or use of it, including product liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- Intellectual property. If a third party claims that the App or your use of it infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement and discharge of that claim.
- Legal compliance. You represent that you are not located in a country subject to a US government embargo or designated as a “terrorist supporting” country, and that you are not on any US government list of prohibited or restricted parties.
- Third-party terms. You must comply with applicable third-party terms (for example, your wireless data agreement) when using the App.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept them, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
14. General
If any provision of these Terms is unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy, are the entire agreement between you and us about TipStub. You may not assign these Terms; we may assign them in connection with a transfer of the App.
